Any reservation can be canceled 30 days or more prior to the rental local start time for a full refund. 

If the Renter cancels the reservation 30 days or more prior to the rental local start time, he/she will receive a refund less applicable Service Fee. 

If either the Boat Owner or the Captain cancels the reservation 15 days or more prior to the rental local start time, the Renter will get a full refund including the Service Fee. 

On the contrary, if the Renter cancels the reservation less than 30 days prior to the rental local start time, he/she will not receive a refund, except for security deposit. 

Moreover, the following provisions will hold true in case of respective responsibilities originating from the Renter, Boat Owner or the Captain: 

If the Boat Owner fails to provide access to the Boat in such cases including, but not limited to, the failure to exchange keys, miscommunication regarding the physical location of the boat, listing inaccuracies, poor functional or presentational features associated with the boat, the Renter will receive a full refund including the Service Fee, while the Boat Owner and the Captain will not receive any payment. In addition, an email notification will be sent to all three parties, the Owner, the Renter and the Captain. 

If the Captain fails to comply with responsibilities associated with operating a vessel including, but not limited to, the failure to show-up at the time of the rental check-in or a situation whereby the Captain arrives unfit to operate the vessel, the Renter will receive a full refund including the Service Fee, while the Boat Owner and the Captain will not receive any payment. In addition, an email notification will be sent to all three parties, the Owner, the Renter and the Captain. 

Finally, if the Renter fails to comply with responsibilities related to the rental check-in including, but not limited to, the failure to show-up at the time of the rental check-in or a situation whereby the Renter arrives with more people than the actual Boat capacity may handle, the Renter will forfeit any type of a refund, while all other parties, including the Boat Owner, the Captain and Skippermyboat will automatically receive respective Fee payments. In addition, an e-mail notification will be sent to all three parties, the Owner, the Renter and the Captain. 

Extenuating Circumstances 

The cancellation policy rules and fees can be superseded by Skippermyboat if certain extenuating circumstances can be shown. 

Both Renter and the Boat Owner are able to cancel the Service by contacting [email protected] and providing appropriate documentation to support the cancellation.

In line with that, the Renter shall receive a 100% refund and the Boat Owner and Captain will not receive payment for the following extenuating circumstances: 

Reservation location of the reserved Boat is within the National Hurricane Center 150 miles cone of probability of named or numbered storms; 

Safety related cancellations originating from, but not limited to, adverse weather conditions and apparent prior to the beginning of the rental. Such conditions include, but are not limited to the event of lightning, thunderstorms, heavy rain, or heavy wind within eight (8) hours of the time of scheduled rental; 

~Natural disaster in general; Political Unrest; Death in the family; 

An issue with the Boat considered to be the responsibility of the Owner that causes the rental to end prematurely; 

Boat Owner cancellation or no access to the boat. In this case, the Boat Owner may be subject to penalties; 

Captain cancellation, no-show of the Captain or no access to the boat. The Captain may be subject to penalties; 

An issue with the rental determined to be the responsibility/or caused by the negligence of the Boat Owner that causes the Renter to end the said rental. In this case, the Boat Owner may be subject to penalties; 

Listing inaccuracies. If the description of the Boat in the listing on the Site is materially or otherwise inaccurate with respect to: the physical location of the Boat (i.e. vicinity) the size of the Boat (e.g, relative but not limited to seating capacity in terms of both the size and number, make and/or model); the fact that another party, including the Boat Owner, may be using the Boat during the reservation time; the fact that special features represented in the listing description may not be provided and/or do not function, such as engines, water, lights, bathrooms (toilet/shower/ bathtub), kitchen (sink/stove/refrigerator or other major appliances), and electrical, wi-fi, heating or air condition systems. 

No Assignment/No Insurance 

The Cancellation Policy and Procedures neither constitutes insurance or an insurance contract, nor is it intended to constitute an offer to insure. It also does not take the place of insurance obtained or obtainable by the Renter, and is not associated with any premium that either the Renter or the Owner may have to pay. 

Modification or Termination 

Skippermyboat reserves the right to modify or terminate this Cancellation Policy, at any time, in its sole discretion, and without prior notice. If Skippermyboat modifies this Cancellation Policy, the modifications will be posted on the Site and/or provided to its clients through a notice of the modification. Moreover, Skippermyboat will continue to process all pending refunds/disputes made prior to the effective date of the Policy modification. 

Entire Agreement and Definitions 

This Cancellation Policy constitutes the entire and exclusive understanding and agreement between Skippermyboat and its clients (“Clients”) consisting of the Renter, the Boat Owner and the Captain and, as such, supersedes and replaces any and all prior oral or written understandings or agreements between Skippermyboat and the Clients regarding the Cancellation Policy. 

Limitation of Liability 

IN NO EVENT WILL SKIPPERMYBOAT’S AGGREGATE LIABILITY, ARISING OUT OF/OR IN CONNECTION WITH THIS SKIPPERMYBOAT POLICY TERMS, EXCEED THE AMOUNT OF THE BOAT FEES COLLECTED BY SKIPPERMYBOAT FROM THE RENTER. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES, SO THE ABOVE LIMITATION MAY NOT APPLY TO YOU. 

General Terms 

YOU ACKNOWLEDGE AND AGREE THAT, BY POSTING A LISTING OR RENTING A BOAT OR OTHERWISE USING THE SERVICES AS AN OWNER OR A RENTER, YOU ARE INDICATING THAT YOU HAVE READ, AND THAT YOU UNDERSTAND AND AGREE TO BE BOUND BY THESE POLICY TERMS. 

Controlling Law 

This Cancellation Policy will be interpreted in accordance with the laws of the State of Delaware and the United States of America, without regard to its conflict-of-law provisions.
